Making A Purchase
Ordering a product could not be easier. Browse through our product categories to get value for money and excellent choice. To view a full description of any title while you are browsing, just click on either screenshot, product description or the more button, this will take you to that product page. Click on any items you wish to buy and put them into your shopping basket. After you have finished your selection of goods, click on checkout and you will be asked a few questions in order to complete your order. We accept all major credit /debit cards.

Payment by Cheque
To pay by cheque print the order summary screen and post it with your payment. If you do not have a printer, simply write your name, order number and address on a piece of paper and enclose it with your signed cheque. Cheques should be made payable to Blue Moon Childrens Education Software Limited and include your order number on the reverse. Please send cheques to Blue Moon Childrens Education Software Limited, 26 Delamere Lane, Western Downs, Stafford ST17 9TL. Your order will be confirmed and prepared for dispatch once your cheque has cleared. Refunds will only be to the original form of payment i.e. credit /debit card or cheque.

Confirmation
1. Clicking the confirmation button at the end of the ordering process acknowledges that you agree to the order as well as to the present general terms and conditions in their entirety and without exception.
2. Data recorded by Blue Moon constitutes proof of all transactions between Blue Moon and its customers.
3. Data recorded by the payment system constitutes proof of financial transactions.

Shipping And Handling
The standard delivery charge is £2.95 per order. We aim to despatch goods within three working days using Royal Mail. Please allow up to seven working days for delivery although this is usually within 48 hours in normal circumstances. We can also offer a next working day delivery in the UK if the order is received by midday Monday to Friday. The cost is £4.99 in addition to the basic £2.95 P&P. Friday orders delivered Monday. Highlands, N. Ireland and UK Islands may take an extra day. This express service is not available to the Channel Islands. A signature will be required on receipt of all orders. Our P&P charges include packaging, handling and free delivery insurance, in addition to postal costs which pay direct to Royal Mail on your behalf.

Delivery Schedule
We deliver anywhere in the United Kingdom and also the Isle of Man and Channel Islands. Delivery is only to the delivery address given when the order was placed. It may not be possible to deliver to some locations. Once goods have been delivered to you they will be held at your own risk and will not be liable for their loss or destruction.

Back Orders
Although we always aim to keep sufficient stock available for all our advertised product lines we cannot always anticipate demand or problems with suppliers or publishers. Should a product be unavailable after you have placed your order we will endeavour to let you know as soon as possible by email or telephone. In this instance you can request cancellation of the order or exchange.
Tax Charges Pricing is subject to change without notice, although products will be invoiced at the price in effect when the order was placed-subject to availability. The prices payable for the goods are as set out in our Web-Site. Information relating to products is also liable to change and is given by way of indication only. All prices include VAT at the current rate of 17.5% where applicable. (No Vat is payable for goods delivered to the Channel Islands)

Returns Policy
We want our customers to be pleased with the quality of the goods you receive. You may cancel your contract with us for the goods you ordered at any time up to the end of the seventh working day from the date you received the ordered goods. You do not need to give us any reason for cancelling the contract, nor will you have to pay any penalty.*You cannot cancel your contract if the computer software has been taken out of the sealed package in which it was delivered to you. To cancel your contract, you must notify us in writing. If you have received the goods before you cancel your contract then unless under the previous terms*you do not have a right to cancel, you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery, you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own risk as soon as possible.
Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card or cheque will be re-credited to your account as soon as possible and in any event within 30 days of your order. PROVIDED THAT the goods in question are returned by you and received y us in condition they were in when delivered to you. If you do not return the goods delivered to you or you do not pay the cost of delivery, we shall be entitled to deduct the direct costs for recovering the goods from the amount to be re-credited to you. If you would prefer the goods to be exchanged. Please note that some items may be out of stock and therefore take slightly longer to deliver.

Compatibility
The company is not responsible for ensuring product compatibility with your computer specification. Packaging of products may be changed by the publishers and may vary from any published package. There is no guarantee you will therefore receive packaging as illustrated.

Cancellation
We reserve the right to cancel the contract between us if:

a. we have insufficient stock to deliver the goods you have ordered
b. we do not deliver to your area: or
c. one or more of the goods you ordered was listed at an incorrect price due to a typographical error in the pricing information received by us from our suppliers.

If we do cancel your contract, we will notify you by email and we will re-credit to your account any sum deducted by us from your credit card or paid by cheque as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Articles and conditions of ownership
We must receive payment of the whole price of the goods that you order before your order can be accepted. Once payment has been received by us, we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us. Title in the goods shall not pass until full payment has been made to the company. The company reserves the right to withdraw and/or edit any product or information within its Web-Site. The company may refuse to proceed, or suspend any transaction for any reason.

Liability
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problems within 10 working days of the delivery of the goods in question.

If you do not receive goods ordered by you within 28 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 35 days of the date on which you ordered the goods. If you notify a problem to us under this condition, our only obligation will be, at your option:

a. to make good any shortage or non delivery
b. to replace or repair any goods that are damaged or defective
c. to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damages or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation, other than to refund to you the amount paid by you for the goods in question under item c above.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or statuary rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury to you for any death or personal injury resulting from our negligence.

Third Party rights
Except for our affiliates, directors, employees or representatives, a person who is not to this agreement has no right under the UK Contracts (Rights of Third Parties)Act of 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Entire Agreement
These terms and conditions, together with our current Web-Site, prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of goods to you by us. Nothing said by any sales person on our behalf shall be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered by sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Events beyond or control
Force Majeure
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect of goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
